ORDER

The petitioner/wife seeks expeditious disposal of MC No.55 of 2024 which is pending on the file of Family Court, Tiruppur.

2. Pursuant to this Court's order dated 26.06.2025, the Judge, Family Court, Tiruppur has forwarded a Report to the Registry dated 01.07.2025 requesting three months time to dispose of M.C.No.55 of 2024. 1/4

3. Learned counsel for the respondent opposes the civil revision petition on two grounds viz., the learned counsel states that since the proceedings have been initiated under Section 125 of Criminal Procedure Code for maintenance, this Court, exercising jurisdiction under Article 227 of Constitution of India, cannot pass any order and secondly, learned counsel states that the respondent/husband has filed transfer petition before the criminal side of this court for transfer of MC No.55 of 2024 seeking to club the maintenance case along with Domestic Violence case.

4. Admittedly, the proceedings are now before Family Court, Tiruppur and there can be no impediment for this Court exercising jurisdiction Article 227 of Constitution of India as a supervisory Court to issue direction regarding effective speedy disposal.

5. Insofar as the contention of the learned counsel for the respondent that transfer petition has been filed for clubbing the maintenance case along with Domestic Violence case, it is always open to the respondent to bring it to the notice of the Court as and when the said transfer petition is being taken on file that time limit has been fixed by this Court. 2/4

6. In view of the above, the civil revision petition is disposed of with a direction to the learned Judge, Family Court, Tiruppur to dispose of MC No.55 of 2024 on merits and in accordance with law on or before 10.10.2025. No costs.
