(Order of the Court was made by The Hon'ble Chief Justice) In these batch of cases, the grievance of the petitioners was that they were sought to be removed as encroachers on the land which is vested with the State Highways Authority, but actually they were patta land holders.

2.Learned counsel for the petitioners has filed in Court an index of additional typed set of papers dated 13.11.2016 showing the proceedings before the District Revenue Officer where qua four petitioners, the land has been found to be patta land. 3.In view of the aforesaid, the only conclusion would be that in so far as the lands having been found to be patta land, the parties cannot be removed from the land alleging them to be encroachers, but in case, the State Highways Authority wants to acquire the land, then due process of law should be followed. If some lands are not patta lands, then, of course, the respondent authorities are free to proceed in accordance with law in pursuance to the show cause notices issued.

4.Writ petitions, accordingly, stand disposed of. No costs. Consequently, all the connected miscellaneous petitions stand closed.
