The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the second respondent to include the name of the petitioner in the list proposed to be placed in the syndicate and to confirm the petitioner's present service seniority as per the UGC guidelines based on the certificates related to my past service submitted by the petitioner.

The prayer as sought for in the writ petition is to include the petitioner's name in the list proposed to be placed before the Syndicate and confirm the petitioner's present service seniority as per the UGC guidelines.
2. According to the counsel appearing for the second respondent, the proposal for counting of past service period one/two years of service rendered by 10 Asst. Professors including the petitioner were requested to submit the required documents for consideration. Based on the resolution of the Syndicate, the petitioner was advised vide letter, dated 28.12.2020 to produce the service certificate endorsed by the authorities. Subsequently, it was noticed that one of the applicant was found ineligible to have past service rendered by her to be counted and the Syndicate had resolved in its 51st meeting held on 25.2.2021 to constitute a New Committee with new members to check the veracity of the certificates etc.
of all the applicants, as per various guidelines in force and has further resolved that based on the report of the Committee, the Syndicate will decide the matter suitably. In these circumstances, the orders issued for counting of two years of service in respect of four applicants had been cancelled. Hence, the action is being taken to constitute a New Committee to verify the veracity of the certificates etc. of the applications as per the guidelines and the claims of applicants will be placed before the New Committee to be constituted and after receipt of the report of the New Committee, the matter will be placed before the Syndicate again for its decision. The petitioner was granted promotion under Career Advancement Scheme on 6.8.2021 with retrospective effect from 8.10.2019.
Therefore, according to the counsel appearing for the second respondent, the prayer as sought for in the writ petition has become infructuous.
3. Recording the said statement, the writ petition stands dismissed as infructuous. If the petitioner is aggrieved, it is open to the petitioner to work out his remedy in the manner known to law. No Costs. Connected miscellaneous petition is closed.
