CMP No.16963 of 2023 in CMA SR No.92523 of 2023 N.ANAND VENKATESH.,J The 2nd respondent has been served with notice and he is represented through a counsel. Notice to the 1st respondent has already been dispensed.

This Civil Miscellaneous petition has been filed seeking to condone the delay of 343 days in filing the Civil Miscellaneous Appeal.

Heard the learned counsel for the Appellant and perused the records.

Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 343 days is condoned.

Registry is directed to number the main Civil miscellaneous appeal and list the same for admission. Registry is also directed to print the name of Mr.J.Michael Visvasam, represented for the 2nd respondent in the cause list at the time of admission and the name of Mr.T.Jayaraman, shall be deleted in the cause list.

It is made clear that for the period of delay of 343 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
