Criminal Revision Case is filed under Section 438 r/w 442 of BNSS, praying to call for the records pertaining to the impugned order in Crl.MP.No.995 of 2025 dated 17.03.2025 on the file of the learned Sessions Judge, I Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai and set aside the same and consequently, direct the respondent police to release the three-wheeler/auto having its brand name as "BAJAJ RE COMPACT LPG COLOUR YELLOW" bearing its registration number as "TN 05 BL 0158" bearing its Chassis Number "MD2A49AY8HWA03901" having its engine/motor number as "24YWHA09151" to the petitioner/owner. This Criminal Revision Case has been filed against the order in Crl.MP.No.995 of 2025 dated 17.03.2025 on the file of the learned Sessions Judge, I Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai, thereby dismissed the petition to return the vehicle. 2.
Heard, the learned counsel appearing on either side and perused, all the materials placed before this Court.

On perusal of records, it is revealed that admittedly the petitioner is not an accused in the present case. The vehicle i.e. three-wheeler/auto having its brand name as "BAJAJ RE COMPACT LPG COLOUR YELLOW" bearing its registration number as "TN 05 BL 0158" bearing its Chassis Number "MD2A49AY8HWA03901" having its engine/motor number as "24YWHA09151", which is owned by the petitioner, was used by the accused persons for illegal transportation of 'ganja' weighing 5.5 kg. In pursuant to the same, the respondent registered FIR in crime No.298 of 2024 for the offence punishable under Sections 8(c), 20(b)(ii)(B), 29(1) & 25 of NDPS Act. After registration of FIR, the vehicle and the contraband were seized by the respondent and produced before the court concerned. Since the confiscation proceedings has already been initiated, the trial court dismissed the petition to
return the vehicle. As such, this Court is not inclined to consider the prayer sought for by the petitioner.

Accordingly, this criminal revision case is dismissed.
