Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 3 to consider petitioner's representation dated 07.12.2020 and consequently direct the third respondent to enquire and not to permit any encumbrances pertainng to the parent document No.194/1990 on the file of SRO, Thondamuthur, Coimbatore District.

ORDER

The present writ petition is filed seeking a direction to the respondents 1 to 3 to consider his representation dated 07.12.2020.

2. The case of the petitioner is that he has advanced certain loan to the fourth respondent and as a security for the same, the latter has entrusted his title deed bearing Document https://hcservices.ecourts.gov.in/hcservices/

No.194/1990 dated 08.02.1990. He adds that he reliably learnt that the fourth respondent has now obtained a certificate as if the said title deed is missing from his custody, and that he is attempting to alienate the property. Therefore, the petitioner has preferred a representation dated 07.12.2020 to the respondents 1 to 3, and required the third respondent to hold an enquiry on the same.

3. Heard the learned counsel for the petitioner and Mr.T.M.Pappiah, learned Special Government Pleader for respondents 1 to 3.

4. The third respondent is now required to hold an enquiry on the representation of the petitioner dated 07.12.2020, within a period of three weeks from the date of service of this order and dispose of the petitioner's representation with a speaking order.
