Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified

Mandamus, to call for the records of the Fourth Respondent in the impugned Show Cause Notice in No.320/PW/SBDII/D5/F.No.PKEC/2019-20 dated 15.07.2019 and quash the same consequently, direct the 3rd to 6th Respondents to revise the material specifications for Item Nos.46, 47 and 48 and to furnish approved designs for the execution of contract etc., to the Petitioner.

O R D E R

When it is pointed out that the show cause notice No.320/PW/SBD-II/D/F.No.PKEC/2019-20 dated 15.07.2019 issued by the Fourth Respondent, which is impugned in this Writ Petition is bereft of any detail so as to enable the Petitioner to submit his explanation for the same, Learned Counsel for the Respondents, on instructions, seeks permission of this Court to withdraw the same with liberty to proceed afresh in the matter against the Petitioner and he has also made an endorsement to that effect.

Recording the aforesaid withdrawal of the show cause notice, which is impugned in the Writ Petition, this Writ Petition is disposed granting such liberty to the Respondents to proceed afresh further in the matter, if necessary against the Petitioner in accordance with law. Consequently, connected miscellaneous petition is closed. No costs.
