ORDER

Mr. G. Krishnaraja, learned Government Counsel takes notice for the second respondent. By consent of both sides, this writ petition is taken up for final disposal at the stage of admission itself.

The present writ petition has been filed by the petitioner seeking to issue a Writ of Mandamus directing the respondents to issue birth certificate to his son named S.Sanjay born on 12.07.2007, by considering his representation dated 25.02.2020.

3. The case of the petitioner is that his son S. Sanjay was born on 12.07.2007, however, due to lack of knowledge about the registration of birth, he did not register the birth of his son S. Sanjay. When his daughter S.Sofiya born on 23.11.2008, he properly registered her birth and also obtained her birth https://hcservices.ecourts.gov.in/hcservices/

certificate. Now, his son S. Sanjay is studying Xth Standard at MCC School and the school authorities asked him to furnish the birth certificate of his son. Therefore, he made several requests to the third respondent for obtaining the birth certificate to his son. The third respondent also directed him to file an affidavit with relevant documents which were also furnished by him. However, the third respondent did not issue the birth certificate and therefore, the petitioner gave a representation dated 25.02.2020 to the third respondent. Though he approached all the respondents for obtaining the birth certificate to his son, his efforts went in vain. Hence, left with no other alternative, he has filed the present writ petition.

4. Heard both sides and perused the materials placed before this Court.

Considering the limited relief sought by the petitioner, this Court, without going into the merits of the case, directs the third respondent to consider the petitioner's representation dated 25.02.2020, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

6. This Writ Petition is disposed of with the above directions. No costs.
