Petition praying that in the circumstances stated therein the High Court will be pleased to relax the conditions imposed on condition that the petitioner shall appear before the learned Special Judge, Villupuram every week on Monday at 10.30 a.m until further orders in crl.M.P.NO.6466 of 2019 dated 08.05.2019. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.L.MAHENDRAN Advocate for the petitioner and of MR.K.PRABAKAR ADDITIONAL PUBLI PROSECUTOR on behalf of the Respondent the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioner/appellant vide order dated 08.05.2019 made in Crl.MP.No.6466/2019 in Crl.A.No.260/2019. This Court, in its order dated 08.05.2019, had suspended the sentence imposed on the petitioner with a direction to report before the Trial Court at 10.30 a.m., on the first working day of every week until further orders.

The learned counsel for the petitioner would submit that the petitioner is a Senior Citizen, aged about 60 years and that he finds it very difficult to travel for nearly 6 hours every week to appear before the Trial Court and would seek that the condition of appearing before the Trial Court on the first working day of every month, be modified.

Heard the learned Additional Public Prosecutor who would submit that the petitioner is complying with the condition regularly. https://hcservices.ecourts.gov.in/hcservices/

This Court also perused the affidavit filed in support of the miscellaneous petition.

Taking into consideration the health condition and the age of the petitioner, the condition imposed vide order dated 08.05.2019, is hereby modified and the petitioner shall appear before the Trial Court once in a month on the first working day of every English Calendar month commencing from the first working day of September 2019 pending Appeal.

The petition is ordered accordingly.
