PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first and second respondents to consider the representation letter dated 12.09.2019 and consequently direct the first respondent to direct the second and the third respondents to allow the petitioner to be the donor and parton for the Aadi Kiruthigai festival 29.07.2024 and pass orders. ORDER

The petitioner has filed this writ petition seeking a direction to respondents 1 and 2 to consider the representation of the petitioner dated 12.09.2019 and pass orders.

2.Mr.S. Ravichandran, Additional Government Pleader takes notice for the Respondents. In view of the consent expressed by the learned counsel appearing for either side, this petition is taken up for final disposal.

3. The case of the petitioner is that he is devotee of the Arulmigu Sundararaja Perumal Thirukovil and Thatheswarar Thirukovil. The ancestors of the petitioner are the donors of the temple for the Aadi Krithigai festival for the past many years. When this being the case, the third respondent who is the hereditary trustee of the said temple is prohibiting the petitioner's family from conducting the said festival and also not permitting the petitioner to be donor and the parton for the said festival. Hence the petitioner gave a representation to the first and second respondents on 12.09.2019 and thereafter made representation before the second respondent on 24.04.2024 and 24.06.2024. However, the same was not considered. Hence this petition.

4. The learned counsel for the petitioner submitted that the Aadi Kirthigai festival falls on 29.07.2024. Hence prays this Court to issue a direction to the second respondent to consider the petitioner's representation and pass orders.

5. The learned Additional Government Pleader appearing for the respondents submitted that they will consider the case of the petitioner and take action in the manner known to law.

Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the case, directs the second respondent to consider the petitioner's representation dated 12.09.2019 and pass orders on merits and in accordance with law, after affording reasonable opportunity of hearing to the petitioner, within a period of one week from the date of receipt of a copy of this order.

7. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
