The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 328 of IPC and Section 7 of Cigarette and other Tobacco Products Act, 2003, in Crime No.130 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused were found in possession of 14.100 Kgs of banned tobacco products. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submits that there are totally 2 accused in which the petitioner is arrayed as A1. The petitioner and other accused were in conscious possession of 14.100 Kgs of banned tobacco products. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and the petitioner was in possession of huge quantity of contraband, the custodial interrogation of the petitioner is very much required in this case and this Court is not inclined to grant anticipatory bail to the petitioner.
