PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to call for the records culminating in the F.I.R. in Crime No.304 of 2018 pending on the file of the 1st respondent i.e. the Inspector of Police, All Women Police Station, Gobichettipalayam, and quash the same.

O R D E R

The present Criminal Original Petition has been filed seeking a relief to call for the records pertains to F.I.R. in Crime No.304 of 2018 pending on the file of the first respondent police and quash the same as illegal.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent police.

3. When the matter came up for hearing, the learned Additional Public Prosecutor appearing for the first respondent police, on instructions, would submit that in respect of the petition mentioned Crime No.304 of 2018, the https://hcservices.ecourts.gov.in/hcservices/ Page numbers

first respondent police completed the investigation and filed the final report and the same was taken on file as Spl.S.C.No.24 of 2019 on the file of the Mahila Court, Erode. The said submission is recorded.

4. Therefore, in view of the above, since the charge sheet has already been filed in the petition mentioned F.I.R., question of quashing the F.I.R does not arise. Hence, the Criminal Original Petition filed by the petitioner is closed with a liberty to the petitioner for filing a similar petition for quashing the charge sheet. Consequently, the connected Miscellaneous Petition is closed.
