J.
The petitioner namely Ranjith, who was arrested and remanded to judicial custody on 29.12.2022 for the offences punishable under Sections 452, 342 IPC r/w 9(n), 10 of POCSO Act in Spl.S.C.No.14 of 2023 on the file of the Special Court for Exclusively trial of cases under POCSO Act, Villupuram, seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated as an accused in Spl.S.C.No.14 of 2023 for the offences Sections 452, 342 IPC r/w 9(n), 10 of POCSO Act. Petitioner is in judicial custody from 29.12.2022. It is his further submission that, petitioner is the brother of victim's father. There is a property dispute between the victim girl's father and petitioner. Therefore, using victim girl, this complaint is given and first information report came to be registered. Thus, he prays for grant of bail.
3. The learned Additional Public Prosecutor, opposes this petition, on the ground that, petitioner had committed sexual assault against the victim girl, who was aged only 6 years. The investigation in this case is pending. 1/3
Therefore, he strongly opposed this petition.
4. Considered the submissions and perused the records.
5. The reading of the Statement under Section 164 of the victim girl shows on the date of the incident the petitioner had removed the dress worn by the victim girl and pressed the private part of the victim girl.
6. Considering the nature of the allegations against the petitioner, and that investigation is not completed, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 25.07.2023 gd 2/3
