ORDER

The prayer sought for herein is for a writ of mandamus to direct the respondents to consider the petitioner's claim for increments for acquiring higher qualification B.A(English) and B.Ed(English) in the light of the representation dated 24.12.2021.

2. The petitioner has been working as a Secondary Grade Teacher. During his service, he acquired additional qualification i.e., B.A. English and B.Ed(English), for those qualifications, the petitioner according to him, is entitled to get the additional incentive increment and in order to get the same, the petitioner has given a representation dated 24.12.2021 to the second respondent, which was not forwarded to the first respondent for sanctioning the same and no action since has been taken on the said representation of the petitioner so far, he has approached this Court by filing the present writ petition with the aforesaid prayer.

3. Heard Mr.G.Punniakoti, learned counsel appearing for the petitioner, who having reiterated the aforesaid would seek indulgence of this Court to issue a direction to the respondents by way of mandamus.

Heard Mr.T.Chezhian, learned Additional Government Pleader appearing for the respondents, who would submit that, whether the petitioner would be entitled to get the advance incentive increment for having the higher qualification viz., B.A.(English) and B.Ed (English) in the year 2012 and 2018 would be considered and in this regard, the representation of the petitioner dated 24.12.2021 would be disposed of on merits and in accordance with law within a time frame that may be stipulated by this Court.

In view of the aforesaid facts, having regard to the said submission made by the learned counsel appearing for both sides especially the stand taken by the learned Additional Government Pleader appearing for the respondents, this Court is inclined to dispose of this writ petition with the following orders:

That there shall be a direction to the respondents 1 and 2 to consider the representation of the petitioner dated 24.12.2021 and pass orders thereon on merits and in accordance with law within a period of eight(8) weeks from the date of receipt of a copy of this order.
