Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 2 to 4 to rectify the defects in the patta Nos.25 and 26 issued for the petitioner's land in E Block, 34 T.S.No.75 (Old S.No.107/2 and E Block 34 TS.No.76 (Old S.No.107/3) situated at Idappadi Taluk, Salem District and issue Patta with correct extent as per the earlier Patta No.308 and 674 issued in the year 2003 by the fourth respondent. 1/5

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This Writ Petition is filed to direct the respondents 2 to 4 to rectify the defects in the patta Nos.25 and 26 issued for the petitioner's land in E Block, 34 T.S.No.75 (Old S.No.107/2 and E Block 34 TS.No.76 (Old S.No.107/3) situated at Idappadi Taluk, Salem District and issue Patta with correct extent as per the earlier Patta No.308 and 674 issued in the year 2003 by the fourth respondent.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that she purchased two properties by way of registered sale deeds in the year 1988 and 1984 measuring to an extent of 5.64 acres and 1.01 acre situated in Idappadi Salem District and patta has also 2/5

been issued to the petitioner in the year 2002. In the year 2016, after conversion of Town Survey, pattas were issued to the petitioner and in those pattas, the measurements have been wrongly mentioned. In this regard, the petitioner has several representations to the respondents to issue patta by correcting the extent. But the same has not been considered by the respondents. Hence, the present Writ Petition.

Considering the limited relief sought for in this writ petition, the respondents 2 to 4 are directed to consider the representation of the petitioner dated 20.08.2022 sent to the fourth respondent and pass appropriate orders on the same on merits and in accordance with law, within a period of two months from the date of receipt of a copy of this order.
