ORDER

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to consider and appoint the petitioners herein as per the orders dated 22.12.2015 passed by this Court in batch of writ petitions in W.P.No.4136 of 2015 dated 22.12.2015 etc., and in W.P.No.18580 of 2023 & W.P.No.21291 of 2023 dated 24.04.2023 as the 2/6

petitioners herein have also already selected in the written examination conducted by the Tamil Nadu Government for the post notified in the notification in G.O.Ms.No.105 Rural Development and Panchayat Raj (SGS II) Department dated 09.11.2012 and the Notification G.O.Ms.No.65 Rural Development and Panchayat Raj (SGS II) Department dated 03.07.2013 within a limited time frame

2. The learned counsel appearing on behalf of the petitioners would submit that they have completed Diploma in Civil Engineering and registered before the District Employment Exchange, Cuddalore. Thereafter, through Employment Exchange, they participated in examination for the post of Technical Assistant. On the basis of marks obtained in the exams and interview, they got selected to the post of Technical Assistant and appointed on a consolidated pay of Rs.12,000/-. It is the submission for the learned counsel for the petitioners that subsequently, their service were terminated on 07.11.2016. According to the petitioners, there are numerous vacancies available in the respondent Department. Hence, they have sent representations to appoint them for the post of Overseer in the Engineering Wing of the Rural 3/6

Development and Panchayat Raj Department, dated 18.02.2024. The said representation is pending on the file of the respondents.

However, the learned Special Government Pleader appearing on behalf of the respondents would strongly object the contention of the petitioners and would contend that the petitioners were terminated from service during 2016 and that the petitioners' representation is nothing but creating a fresh cause of action upon the stale claim. Hence prayed to dismiss the writ petition. However, the learned counsel would fairly submit that the representation of the petitioners is still pending with them and they would consider the same within a reasonable time.

4. I have given my anxious consideration on either side submission.

5. In view of the said fair submission made by the learned Special Government Pleader, without going into the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioners' representation dated 18.02.2024 and pass order on its own merits 4/6

and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above observations, the Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition stands closed. 25.06.2025 (1/2) ssi Index : Yes Speaking Order : Yes/No To:
