The Writ Petition has been filed to direct the first respondent to consider the petitioner's representation dated 14.09.2020.

Heard Mr.V.Sakkarapani, learned counsel appearing for the petitioner, Mr.A.Selvendran, learned Special Government Pleader appearing for the respondents 1 & 2 and Ms.R.Poornima, learned counsel appearing for the third respondent. https://hcservices.ecourts.gov.in/hcservices/

The petitioner filed a petition before the respondents 1 & 2, challenging the patta issued in favour of the third respondent herein. Since the same was not considered by them, the petitioner filed this Writ Petition with the above said prayer. It is seen that as per Section 12 of the Patta Passbook Act, 1983, the first respondent has jurisdiction to deal with the appeal as against the issuance of patta.

Considering the facts of the case, the petitioner is directed to submit a fresh appeal before the first respondent as against the issuance of patta in favour of the third respondent, within a period of two weeks from the date of the receipt of a copy of this Order. On receipt of the same, the first respondent is directed to issue notice to the petitioner and the third respondent and after giving them opportunity of hearing, pass orders on merits and in accordance with law, within a period of twelve weeks thereafter.
