Placing reliance on the Judgment and Decree granted in O.S.No.2 of 2003, on the file of District Munsif Court, Tiruvallur, the petitioner submitted a representation dated 07.10.2013, to the respondents, seeking survey of the property to an extent of 73 cents comprised in S.No.219/1A, 88.5 cents comprised in S.No.213/1, 12 cents comprised in S.No.226/3A1, 32 cents comprised in S.No.226/3A6A, 32 cents comprised in S.No.226/5 and 2 cents comprised in S.No.229/3B situate at Perumbakkam Village, Thiruvallur Taluk, Thiruvallur District. taken on the said representation, the petitioner has come forward with the present Writ Petition.
2.Taking into consideration of the pendency of the representation, and as the matter lies in a very narrow compass, without going into the merits of the case and based on the averments made in the affidavit, the writ petition is disposed of with the following direction:- "The petitioner shall submit another copy of the representation dated 07.10.2013, by enclosing the copy of this order, within a period of two weeks from the date of receipt of a copy of this order to the second respondent, who shall consider the same and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order or on its production, after giving an opportunity of hearing to the petitioner and to the rival claimants if any, who are likely to be affected by the said exercise. It is made clear that no opinion is expressed by this Court on the merits of the case or the claim of the petitioner".
No costs.
