ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 118(1), 109 of B.N.S @ 296(b), 118(1), 103(1) of B.N.S in Crime No.105 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that Sathish, the husband of Lakshmi Priya, was found with severe injuries and later succumbed to the same. Based on the complaint given by the relatives of the deceased, the respondent police

registered the case in Crime No.105 of 2026. The petitioner is one of the accused in the said occurrence.

The learned counsel appearing for the petitioner would submit that there is no overt act attributed against this petitioner in the FIR and the co-accused have already been released on bail in Crl.O.P.No.12335 of 2026 dated 02.06.2026. It is further submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would strongly oppose the application and submit that there are specific allegations against the petitioner and the investigation is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

This Court is of the view that though the learned counsel for the petitioner would submit that there is no overt act against the petitioner and that the co-accused have been enlarged on bail, on a perusal of the FIR there are specific allegations as against this petitioner. Apart from that, according to the

learned Government Advocate (Crl.Side), the investigation is still pending. Taking into consideration the stage of investigation, if the petitioner is enlarged on anticipatory bail, it would prejudice the investigation. Therefore, it is not desirable to enlarge the petitioner on anticipatory bail.
