Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to give the alternative house as per representation made by the petitioner on 08.02.2016 instead of H-48 of Ariyalur Kurumbanchavady NHS Phase-II Scheme.

ORDER

By consent, the writ petition is taken up for final disposal. The petitioner in response to the publication effected for allotment of HIG Flat in Kurumbanchavady NHS Phase-II Scheme, Ariyalur, submitted an application to the 2nd respondent on 13.12.2010 for allotment under Self Finance Scheme and a lot was conducted on 21.11.2011 and the petitioner became successful and was alloted a house bearing No.H-48 in General category. Though the possession of the house has been handed over, no access is available so as to enable the petitioner to put up a superstructure. In this regard, the petitioner has submitted a representation on 08.02.2016 to the respondents praying for allotment of alternate Plot in lieu of H-48 and though it was received and acknowledged, no orders have been passed and therefore, the petitioner has come up with the present writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.V.Anandamoorthy, learned counsel who accepts notice on behalf of the respondents and he would submit that it is for the Managing Director of the Tamil Nadu Housing Board, https://hcservices.ecourts.gov.in/hcservices/

Nandanam, Chennai-35, to pass orders on the representation submitted by the petitioner.

Though the petitioner has prayed for a larger relief, this Court in the light of the facts and circumstances and without going into the merits of the same, directs the 1st respondent to forward the petitioner's representation dated 08.02.2016 to the Managing Director, Tamil Nadu Housing Board, Nandanam, Chennai600035, within a period of one week from the date of receipt of a copy of this order and the said official, on receipt of the said representation, is directed to consider the same on merits and in accordance with law, within a further period of six weeks thereafter and communicate the decision taken, to the petitioner.
