PETITION filed under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus or order or direction in the nature of a writ directing the respondents to grant emergency leave for a period of 15 days to the petitioners husband Mani @ Manikandan (Male/48 years) (Prisoner No.4954) who is confined in Special Sub Jail, Yanam, Puducherry based upon the application of the petitioner dated 26.05.2026 for the medical treatment of the petitioner's minor son Adithya Varma (aged 6 years) who is suffering from right upper limb branchial plexus injury and the medical treatment of the petitioner's daughter Loveleena (1 and half years) who is suffering from rare pyrexia fever and pass such further or other orders. O R D E R
(Order of the Court was made by Dr.Anita Sumanth J.) Mr.M.V.Ramachandra Murthy, learned Public Prosecutor (Puducherry) accepts notice for the respondents and is armed with necessary instructions to enable this Court to dispose the matter finally. Hence, by consent of both sides, final order is passed in this Writ Petition, even at the stage of admission.
2. The prayer in this Writ Petition is for a direction to the respondents to grant emergency leave for a period of 15 days to the petitioner's husband Mani @ Manikandan (Convict), confined in Special Sub Jail, Yanam, Puducherry based on the petitioner's representation dated 26.05.2026.
3. The petitioner is the wife of the convict. They are stated to have a minor son Adithya Varma, 6 years old, who is suffering from right upper limb branchial plexus injury and a minor daughter Loveleena, 1 1⁄2 years old, who is suffering from pyrexia fever.
4. On instructions, Mr.Ramachandra Murthy states that they have received representation dated 26.05.2026. Since the prayer in the representation involves assimilation of facts and the medical records of the children, we are of the considered view that it is best left to the authorities to take a view on representation dated 26.05.2026.
5. Mandamus is hence issued to R3, Superintendent of Prison, Special Sub-Jail, Yanam, Puducherry to consider representation dated 26.05.2026 and pass orders in accordance with the extant Regulations and Guidelines, within a period of two (2) days from today.
6. This Writ Petition is disposed as above.
