Original Petition in O.P.No.577 of 2000 is filed under Sections 222 and 276 of the Indian Succession Act, XXXIX of 1925, for the grant of Probate. As per order of this Court dated 16th day of June 2004 in Application No.947 of 2004, Probate granted on 23rd day of July 2003, in O.P.No.577 of 2000 is revoked. As per order of this Court dated 23.02.2016, the Original Petition has been converted into Testamentary Original Suit No.16 of 2016.

JUDGMENT

Original Petition filed for the grant of probate in respect of Last Will and Testament of deceased A.Saraswathi.

2. The above said Original Petition had been contested and it was converted as T.O.S.No.16 of 2016.

3. The contesting defendant had remained ex-parte. Thereafter, the matter was referred to the learned Master for recording ex-parte evidence.

4. In support of the suit claim, PW-1 and PW-2 have been examined and Exs.P1 to P6 have been marked and it is found that the plaintiffs have established the suit claim.

5. Accordingly, the TOS is decreed as prayed for. Probate is granted as prayed for.

6. Registry is directed to comply further formalities for the issue of probate.
