O R D E R
(through Video Conference) This Criminal Original Petition has been filed seeking direction to direct the second respondent police to withdraw the case in Crime No.258 of 2018 on the file of Thali Police Station and to readdress the same to the file of CBCID or any other agency for better investigation within the stipulated time fixed by this Court.
2.Heard Ms.S.Deepika, learned Counsel appearing for the Petitioners and Mr.S.Karthikeyan, learned Additional Public Prosecutor appearing on behalf of the respondents 1 and 2. 3.Today, when the petition is came up for hearing, the learned Additional Public Prosecutor appearing for the respondents 1 and 2, on instructions, would submit that in https://hcservices.ecourts.gov.in/hcservices/
respect to the petition mentioned crime number i.e., Cr.No.258 of 2018, the second respondent herein completed the investigation and filed final report on 02.10.2020 before the Tahsildar, Thenkanikottai as Further Action Dropped. However, he fairly conceded that R.C.S.notice, in respect to the filing of final report has not been served to the petitioner till date. The said submission is recorded.
4.Thus, in view of the above, since already investigation in petition mentioned in Crime number is completed, nothing survives for further adjudication in this case. However, the second respondent police is directed to serve the R.C.S.notice in S.No.22 of 2020 to the petitioners within a period of one week from the date of receipt of copy of this order. Upon such receipt of the notice, the petitioners are at liberty to file necessary application before the competent forum. 5.With the above directions, this Criminal Original Petition is closed.
