Respondents Prayer: The Criminal Original Petition has been filed under Section 482 Cr.P.C to direct the First respondent to remove the name of the petitioner from History Sheet maintained by the Inspector of Police, Kancheepuram Taluk Police Station, Kancheepuram the second respondent herein by considering the representation of the petitioner dated 07.09.2020 on the file of the Respondents.

ORDER

The Criminal Original Petition has been filed seeking for a direction to the first respondent to remove the petitioner's name from the History Sheet maintained on the file of the second respondent police station. 2.According to the petitioner, he is leading a peaceful life with his family members and the criminal case has been registered against him in the year 2006 and the same ended in acquittal on 11.06.2007 and thereafter, for the past 14 years, no criminal case has been levied against him in any police station. However, the second respondent has opened the History Sheet against him without any basis and guidelines and the same is illegal and therefore, seeking for the removal of his name in the History Sheet, he sent a representation on 07.09.2020 to the respondents but no action had been taken by the respondents with reference to the same and left with no other alternative, according to the petitioner, he has been necessitated to prefer the criminal original petition for appropriate relief. 2/5

3.At the time when the case is taken up for hearing, the Additional Public Prosecutor represented that the Superintendent of Police, Kancheepuram District, Kancheepuram, is the competent authority to dispose of the representation given by the petitioner seeking for the deletion of his name from the History Sheet and accordingly submitted that the Court may direct the Superintendent of Police, Kancheepuram District, Kancheepuram, to consider the representation preferred by the petitioner and dispose of the same in accordance with law within a specific time frame. Only for the said relief, the petitioner has also come forward with the Criminal Original Petition.

Considering the abovesaid factors in toto, I am of the considered view that in the fitness of things, if a suitable direction is given to the Superintendent of Police, Kancheepuram District, Kancheepuram, to dispose of the representation given by the petitioner dated 07.09.2020, the same would meet the ends of justice.

In the light of the abovesaid factors, the Superintendent of Police, Kancheepuram District, Kancheepuram, is directed to consider the representation given by the petitioner on 07.09.2020 seeking for the deletion of his name from the History Sheet and dispose of the same in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
