PRAYER: Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified Mandamus calling for records of the impugned order dated 21.06.2022 bearing No.11561/AA1/2021 passed by the 3rd Respondent and the consequent remarks made in the encumbrance certificate of the property comprised in S.nos.82,83,84,85,86/1 Mavuthambathi Village, Madukkarai, Coimbatore, measuring about 20.30 acres in total and quash the same and direct the Respondents 1 to 4 to remove the entries made in the encumbrance certificate of the said property in pursuance to the impugned order dated 21.06.2022 bearing no.11561/AA1/2021 passed by the 3rd respondent and pass orders.

By consent of both the parties this writ petition is taken up for disposal at the admission stage itself.

2. This writ petition is filed for issuance of Writ of calling for the records of the 3rd respondent in his proceedings Na.Ka.11561/AA1/2021 dated 21.06.2022 and to quash the same.
3. Since, no adverse order is being passed as against the private respondents, notice to the private respondents is dispensed with.
4. The petitioner has challenged the proceedings of the 3rd Respondent/District Registrar( Admin) in this writ petition. On going through the impugned order it is made clear that there is a remedy available to the petitioner to file an appeal before the Deputy Inspector General of Registration/2nd respondent herein.
5. In view of above the petitioner is directed to file an appeal before the Deputy Inspector General of Registration within a period of four weeks from the date of receipt of a copy of this order and if such appeal is filed the Deputy Inspector General of Registration is directed to dispose of the same on merits and in accordance with law, within a period of twelve weeks from the date of filing of such appeal. 3/5
6. With the above direction, this writ petition is disposed of. No order as to costs. Consequently the connected miscellaneous petitions are closed.
