Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.464/2019 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner by the Learned Mahila Court, Spl Court for Cases Under POCSO Act/Childrens Court, Chennai-600 104, made in S.C.No.172/2016 by Judgement dated 28.05.2019, and may be pleased to enlarge the petitioner on bail, pending disposal of the above mentioned criminal Appeal No.464/2019.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl. Appeal No.464/2019 on the file of the High Court and upon hearing the arguments of M/S.GANESH RAJAN, Advocate for the petitioner and of MR.KRITIKA KAMAL.P Government Advocate [crl.side]on behalf of the Respondent the court made the following order:- The petitioner was charged for the offence under Section 307 (2 counts) IPC in S.C.No.172 of 2016 but has been convicted for the offence under Section 326 (2 counts) IPC on 28.05.2019 by the Mahila Court, Chennai. Challenging which, the petitioner has filed the present criminal miscellaneous petition and seeking for suspension of bail.
2. It is seen that the accused attacked his wife Gowri (PW-2) and her sister Dhanalakshmi (PW-3) with the lethal weapon viz., Aruval and both of them sustained grievous injuries. The Doctors evidence shows that Dhanalakshmi (PW-3) had to undergo a surgery and has gone up to the stage of coma in the attack by the petitioner. https://hcservices.ecourts.gov.in/hcservices/
3. Under such circumstances, this is not a fit case to grant suspension of bail, at this juncture.
