By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of Certiorarified Mandamus calling for the records relating to the impugned order passed by the respondent in application No.TN-7202301251289 dated 25.01.2023 and quash the same as illegal and consequently direct the respondent to issue legal heir certificate in favour of the petitioner as legal heirs of Mathaiyan respectively.

3. At the outset, it is submitted by the learned counsel for respondent that the petitioner has a right of appeal in terms of G.O.Ms.No.478, Revenue and Disaster Management, Revenue Administration Wing, RA-3(2) Section, dated 29.09.2022, which the petitioner has not availed off.

4. When this was pointed out, learned counsel for petitioner sought liberty of this Court to approach the appellate authority and file an appeal in terms of G.O. Ms.No.478 dated 29.09.2022.

5. In that view of the matter, the writ petition stands disposed of. It is open to the petitioner to file appeal within a period of 2 weeks from the date of uploading of web copy without waiting for receipt of certified copy of this order. If any such appeal is filed within the stipulated period, the same shall be considered and disposed of by the appropriate authority on merits and in accordance with law after affording a reasonable opportunity of hearing to petitioner, Mathaiyan's 1st wife and daughter and other interested parties. It is

made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
