This petition has been filed seeking to quash the F.I.R. pending 1/4
in Crime No.16 of 2023 on the file of the first respondent. 2.Heard the learned counsel for the petitioners, the learned Government Advocate (Crl. Side) appearing on behalf of the first respondent and the learned counsel for the second respondent. 3.This quash petition has been filed to quash the F.I.R. based on the compromise between the parties. The first petitioner and the second respondent who are the husband and wife have already amicably settled the dispute and they have jointly filed a petition for mutual consent divorce before the Family Court, Krishnagiri in O.P.No.18 of 2024. The second respondent has agreed to withdraw all the pending cases. Accordingly, the maintenance case that was filed in M.C.No.4154 of 2023 was withdrawn on 18.11.2023. Yet another petition in H.M.O.P.No.127 of 2023 seeking for restitution of conjugal rights was also dismissed as withdrawn on 02.12.2023. In the terms of settlement filed in the mutual consent case, the second respondent has also agreed to withdraw the criminal case. 4.In the light of the above development, no useful purpose will 2/4
be served in keeping the investigation pending. Hence, the F.I.R. in Crime No.16 of 2023 on the file of the first respondent is quashed on the ground of compromise. Accordingly this criminal original petition stands allowed. Consequently, the connected miscellaneous petition is closed.
