Narayanan ..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the official respondents 1 and 2 and 4 and 5 to exhume the body buried in survey No.271/2, situate at Poonapalli village, Hosur Taluk, Krishnagiri District and bury the remains of the dead body in the licensed/designated existing samathis from survey No.271/2 and ensure

that no burial shall be allowed to take place in the said survey No.271/2 based on the petitioner's representation dated 13.5.2024. For Petitioner(s) :

ORDER

This writ petition is filed to consider the petitioner's representation dated 13.05.2024.

2. Learned counsel for the petitioner would submit that the petitioner has made a representation dated 13.05.2024 before the respondents 1, 2, 4 and 5 to exhume the body buried in Survey No.271/2, situate at Poonampalli Village, Hosur Taluk, Krishnagiri District and bury the remains of the dead body in the licensed/designated existing burial ground at Chinabelakondapalli Village and remove the existing samathis from Survey No.271/2 and ensure that no burial shall be allowed to take place in the said survey No.271/2. However, the same is not considered, as on date. Hence, this writ petition.

3. Learned Government Advocate appearing for the respondents 1 to 5 would submit that the petitioner's representation dated 13.05.2024 will be considered by the fifth respondent, as expeditiously as possible.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, issues the following directions:

(i) The fifth respondent is directed to dispose of the petitioner's representation dated 13.05.2024, after issuing due notice and opportunity of personal hearing to the petitioner as well as private respondents and aggrieved parties, if any, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order; (ii) In the event the petitioner is inclined to claim compensation, it is upto him to give a representation on that aspect;

(iii) On such receipt, the concerned respondent is directed to dispose of the same, along with the aforesaid representation dated 13.05.2024. With the aforesaid directions, this writ petition stands disposed of. No costs.
