The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Section 394 IPC, in Crime No.05 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. It is the submission of the learned counsel for the petitioner that petitioner is an innocent person and he has been falsely implicated in Crime No.05 of 2022, for the alleged offence under Section 394 IPC. 3.In response, the learned Government Advocate (Crl.side) submitted that defacto complainant is taking care of the property of one Leelavathy Ammal. In the said property, one Rahul, Rajan, Sandeep and Azar are living. On 01.01.2023, at about 2.00 a.m., some unidentified persons had knocked their door. When Rahul opened the door, those persons showing knife, threatened him to give his mobile phone. When Rahul made noise, they snatched his cell phone and ran away. He further submitted that none of the accused is arrested and the mobile phone is
also not recovered so far.
4.Considering the nature of the allegation made against the petitioner and the fact that the mobile phone said to have been snatched from Rahul is not recovered for the reason that the accused are absconding and also the fact that investigation in this case is not completed, this Court is not inclined to grant anticipatory bail for the petitioner.
5.Accordingly, this Criminal Original Petition is dismissed. 31.07.2023 sli
