Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the respondents particularly 2nd and 3rd respondents to consider the petitioner's application dated 11.01.2023 to survey and demarcate the property situated in WardB, Block-15 Town Survey No. 107 measuring to an extent of 0.07 1/3 cents and 0.05 cents,49 Kaivilancheri, Thenpathi Village, Sirkali Town and Taluk, Mayiladuthurai District within the limits of SROSirkali.

ORDER

This Writ Petition has been filed for a direction, directing the respondents 2 and 3 herein to consider the application submitted by the petitioner dated 11.01.2023 seeking to survey and demarcate the property situated in Ward-B, Block-15, Town Survey No.107, admeasuring 0.07 1/3 cents and 0.05 cents situated at 49, Kaivilancheri, Thenpathi Village, Sirkali Taluk, Mayiladuthurai District.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner owned a property situated in Ward-B, Block-15, Town Survey No.107, admeasuring 0.07 1/3 cents and 0.05 cents situated at 49, Kaivilancheri, Thenpathi Village, Sirkali Taluk, Mayiladuthurai District, by way of sale deed dated 12.03.1986 registered vide document No.222 of 1986 from her vendor. The petitioner is in possession and enjoyment of the subject property. However, it was not demarcated and laid any boundary stones in and around her property.

Therefore, the petitioner submitted an application before the second respondent to survey the petitioner's land and she also paid requisite fees. So far the second respondent did not take any steps to survey and demarcate the land belongs to the petitioner. Hence, this writ petition.

In view of the above, the second and third respondents are directed to issue notice to the petitioner and the adjacent land owners and conduct survey and demarcate the subject property as per the documents produced by the petitioner within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition stands disposed of. No costs.
