Respondent(s) PRAYER: Writ petition is filed under Section 226 of the Constitution of India for issuance of a Writ of mandamus directing the 4th respondent to rectify the mistake by deleting the petitioners' name in the tentative Seniority list of Wireman in Sl.No.241, vide Memo. No.545 / Niruvaga Pirivu-2 / Uthavi - 1/ Ko.Mu.Pa / 2007-1 dated 6.3.2007 and include his name in the tentative seniority list of Commercial Assistant in Sl.No.46A between Mr.K. Nedungilli Sl.No.46 and Mr. Madhivanan, Sl.No.47, vide Memo. No.00037/ Niruvaga Pirivu - 2 / Uthavi -1/ Ko.Mu.P / 2007-1 dated 6.3.2007 and promote the petitioner as Commercial Inspector w.e.f. 9.5.2007, on par with juniors and consequentially fixing his seniority in Sl.No.41 A between S.Lawrence Sl.No.41 and R.Jayabalan Sl.No.42, in the Tentative Seniority list of Commercial Inspector vide Memo.No.1095/Nir pirivu-2 / Uthavi - 1 / Ko.Mu.P (Va.Aa)/2011-1 dated 07.02.2011 and promote the petitioner as Foreman GradeI w.e.f. 27.04.2015 on par with his juniors, with consequential monetary benefits.

ORDER

This Writ Petition has been filed to direct the 4th respondent to rectify the mistake by deleting the petitioners' name in the tentative Seniority list of Wireman in Sl.No.241, vide Memo dated 6.3.2007 and include his name in the tentative seniority list of Commercial Assistant in Sl.No.46A and promote the petitioner as Commercial Inspector w.e.f. 9.5.2007, on par with juniors and consequently fix his seniority in Sl.No.41 A in the Tentative Seniority list of Commercial Inspector vide Memo dated 07.02.2011 and promote the petitioner as Foreman Grade-I w.e.f. 27.04.2015 on par with his juniors, with consequential monetary benefits.

2. Mr.S.N.Ravichandran, the learned counsel for the petitioner, submitted that by an order dated 01.08.2006 the petitioner was re-designated as Wireman. However, without promoting him from Wireman to Line Inspector to Foreman, he was placed as Commercial Assistant on 05.11.2007 and his next level of promotion is Commercial Inspector. As the petitioner was placed under the panel of Wireman, though he was put back to post of Commercial Inspector, he could not get his promotion in time. The petitioner's representation in this regard has also not been considered by the respondents so far.

3. Unless an order is passed on the representation made by the petitioner, the petitioner may not be able to know the entitlement of the relief claimed by him. As the petitioner representation remains unanswered and without consideration, I feel appropriate directions to be given to the respondents in this regard.

4. Accordingly, this Writ Petition is disposed by directing the respondents to consider the representation of the petitioner and dispose the same on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs. Connected miscellaneous petition is closed.
