Respondents Prayer: This Writ petition has been filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records of the first respondent in RE.D1/RP No.1/07 (L.Ref) dated 10.01.2007 in favour of the respondents 3 and 4 herein in respect of the land in S.F.No.31/1(Part) of an extent of 3 Ac, Dry in Chinna Allerahally village, Bochampally Taluk, Krishnagiri District, and to quash the same and consequently direct the 2nd respondent to consider the representation dated 03.04.2008 of the petitioner herein in respect of the above said lands based on the Revenue records produced before the authorities. ORDER
When the matter came up on 28.06.2018, the learned counsel for the petitioner has filed a memo stating that the petitioner has handed over the entire papers including the change of vakalat in the year 2012 itself and they report no instructions and the learned counsel for the respondents would submit that the matter has been settled between the parties and nothing survives in this writ petition. Therefore, in order to give an opportunity to the petitioner, the petitioner name was directed to be printed in the cause list and, the registry was directed to verify any vakalat has been filed on behalf of the petitioner and print the name of the petitioner in the cause list. Accordingly, the matter was directed to be posted on 03.07.2018. When the matter was called on 03.07.2018, there was no representation on behalf of the petitioner. Therefore, in order to give another opportunity to the petitioner the Registry was directed to post the Writ Petition today (04.07.2018) under the caption 'for dismissal'.
Even today, there is no representation for the petitioner. Hence, the writ petition is dismissed for non-prosecution.
Consequently, connected miscellaneous petition is closed. No costs.
