K.Duraisamy (Subsequently Died) v. T.Rajendran

C.M.P.No.19324 of 2021 C.M.P.No.19324 of 2021 and S.A.Sr.No.92803 of 2021 G.CHANDRASEKHARAN , J., This petition is filed for accepting the cause title.

2. The learned counsel for the petitioner submitted that the sole plaintiff K.Duraisamy died after the disposal of the first appeal in AS.No.18 of 2018. Petitioners wanted to file the Second Appeal by impleading 4th respondent as legal heir of deceased K.Duraisamy. 4th Respondent is not co-operating with the petitioners to file the Second Appeal and therefore, she is shown as 4th respondent in the appeal. Thus, the learned counsel for the petitioner prayed for accepting the cause title.

3. Considering the fact that sole plaintiff K.Duraisamy died after the disposal of the first appeal in AS.No.18 of 2018 and the other reason that 4th respondent is not ready to co-operate with the petitioner and considering the reasons stated in the affidavit filed in support of the petition, this petition is ordered as prayed for.
