This Petition has been filed to condone the delay of 42 days in filing petition to set aside the abatement caused due to death of the third respondent in the above first appeal.

2. Heard the learned counsel for the petitioners and the learned counsel for the respondents.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsel on either side, the delay of 42 days in filing Appeal Suit No.533 of 2013 is condoned.
