ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 457, 380 & 381 of I.P.C in Crime No. 498 of 2021, seek anticipatory bail. 2.The case of the prosecution is that the De-facto Complainant had lodged a complaint against the petitioner stating that the petitioner colluding with the other accused persons who are the staff members of the Rice Godown run by the De-facto Complainant had stolen rice bags worth about Rs.20,00,000/- from the said Godown. Based on the said complaint, the law enforcing agency registered a case against the accused persons.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl.Side) submitted that the investigation is under way in this case and that the petitioner has been arrested. He further submitted that the stolen rice worth about https://hcservices.ecourts.gov.in/hcservices/

Rs.1,35,000/- has been recovered, however, the balance rice stolen is yet to be recovered.

5. Considering the allegation levelled against the petitioner and further taking into consideration the gravity of the offence committed by the petitioner and the stolen rice is yet to be recovered in full, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the petition seeking anticipatory bail is dismissed.
