ORDER
The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus forbearing respondents 2 and 3 from proceeding with the survey, demarcation, boundary fixation, mutation, or recognition of subdivision survey records in respect of Survey No. 536/8, or otherwise disturbing the petitioner's peaceful possession.

The learned counsel for the petitioner submitted that based on the request made by the 4th respondent, the official respondents attempted to survey the property, including the petitioner's property comprised in Survey No. 536/8. But, originally, the application for survey was restricted only to Survey
No.536/2, which belongs to the 4th respondent. Challenging the same, the petitioner is before this Court.
3. The learned Government Advocate appearing for the respondents submitted that they intend to survey the properties based on the application made by the 4th respondent. While surveying the property, they will take the measurements and alignment from the main survey points. Apart from that, they shall not survey the property in Survey No. 536/8 under any circumstances. However, they intend to survey only Survey No. 536/2, and upon completion of the survey, they will fix the boundary stones. She further submitted that the respondents have already issued a notice to the petitioner, and the petitioner has also filed his objections.

Such being the case, where the respondents intend to conduct a survey and install boundary stones upon the request made by the 4th respondent, and where notice was duly issued to the petitioner who has filed his objections, this Court directs the respondents to consider the objections filed by the petitioner and thereafter conduct the survey in respect of Survey No. 536/2, as contended by the learned Government Advocate.
5. With the above directions, this Writ Petition stands disposed of. It is made clear that the petitioner shall not cause any disturbance during or upon completion of the survey. In the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court, unless the parties arrive at an amicable settlement; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. There shall be no order as to costs.
