This petition has been filed to modify the condition No.7 imposed upon the petitioners while granting anticipatory bail vide order dated 07.06.2023 in Crl.O.P.No.12473 of 2023 that the petitioners to make nonrefundable deposit of Rs.1,65,000/- (Rupees one lakh sixty five thousand only) by way of Demand Draft/RTGS/NEFT to the credit of District Revenue Officer, Vellore District.

The learned counsel for the petitioner would submit that the contraband involved in this case is 750 kgs of PDS rice and the value of the same is only Rs.24,750/-, however it was wrongly represented that the value of the PDS rice was Rs.8,16,750/- and hence, this Court has directed the petitioners to deposit a sum of Rs.1,65,000/- by way of Demand Draft/RTGS/NEFT to the "District Revenue Officer, Vellore District. The learned counsel would further submit that the petitioner is a Coolie and unable to deposit such huge amount and thereby, seek modification of the said condition.

3. Learned Government Advocate (Criminal Side) has submitted that the value of the contraband is Rs.24,750/- and has no objection for the the modification of the earlier order.

Considering the above facts and the submissions made by the learned counsel on either side, the abovesaid condition No.7 is modified to the effect that the petitioners are directed to make a non refundable deposit of Rs.20,000/- (Rupees twenty thousand only) by way of Demand Draft/RTGS/NEFT to the "District Revenue Officer, Vellore District. The other conditions shall remain unaltered.

5. Time for execution of sureties is extended by two weeks from today (31.07.2023). With the above modification, this Criminal Miscellaneous Petition stands ordered.
