Writ Petition is filed for issuance of Writ of Mandamus, directing the respondent to pass orders on the representation made by the petitioner dated 10.06.2019 for considering his claim to revise his seniority in the cadre of Gr-II PC at par with his batch mates appointed to service on 30.11.03 and commenced their training on 01.12.03 and grant him all consequential benefits, within a limited time frame.
2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent. By consent of both sides, the writ petition is taken up for final disposal at the admission stage itself. 3.The petitioner had participated in the selection process for recruitment to the post of Grade-II PC in the year 2003 and
after legal battle, he was appointed as Grade-II PC in the year 2005. Thereafter, the petitioner undergone training and posted as TSP VII Bn, Palani for two years. Thereafter, he was transferred to TSP, Veerapuram, where he served till 2009 and on completion of 4 years of service in the Battalion, he was transferred to Chennai City Armed Reserve on 08.08.2009 and thereafter, he was transferred to Taluk Poice establishment in July 2011. He was upgraded as Gr-I PC in July 2015. Though he entered service in the year 2003, he continued the post of Gr.I P.C without any promotion. Therefore, he made a representation on 10.06.2019 to the respondent to consider his claim and revise his seniority in the cadre of Gr-II PC at par with his batchmates appointed to service. Till date, the petitioner's representation was not considered. Hence the present writ petition is filed.
4.The learned counsel for the petitioner submitted that it would suffice if a direction is passed to the respondent to consider the representation of the petitioner dated 10.06.2019, within a reasonable time as fixed by this Court. 5.The learned counsel appearing for the respondent accede to the submission made by the learned counsel for the petitioner and submitted that if any such representation was received by the respondent, the same will be considered on merits and in accordance with law.
6.Thus, without going into the merits of the case, this Court is inclined to direct the respondent to consider the representation of petitioner dated 10.06.2019 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order. 7.With the above direction, the writ petition stand disposed of. No costs.
