The applicant who is the petitioner in the above Original Petition has filed this application seeking permission to examine the third party who is conversant with the signatures of the attestors and executant and who was present at the time of the execution of the Will.

2. The learned counsel for the applicant / petitioner submitted that both the attestors are not traceable.

3. The respondent who is the brother of the petitioner is also a beneficiary. He did not raise any objection for cross-examining the third party for the purpose of proving the Will.

4. Hence this application is allowed.
