The petitioner, who was arrested and remanded to judicial custody on 09.03.2022 for the offences punishable under Sections 6 read with 5(l), 5(n) of POCSO Act and Section 506 part I IPC in Crime No.02 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner has committed penetrative sexual assault on his own daughter. Hence, the complaint.

3. The petitioner is father of the victim girl aged about only 14 years. On perusal of the statement recorded under Section 164 of Cr.P.C. revealed that the petitioner administered some toxin to the victim girl. Then he had committed penetrative sexual assault on the victim girl on several occasions and also threatened her not to disclose the same to anybody.

4. Therefore, the petitioner who is being the father of the victim girl has committed very serious and heinous offence as against his own daughter and this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
