O R D E R

The petitioner, who was arrested and remanded to judicial custody on 15.06.2022, for the offence punishable under Section 8(c) read with Section 20(b), (ii)(C), 29(1) and 25 of NDPS Act in Crime No.15 of 2022, registered on the file of the respondent, seeks bail.

2. The petitioner herein is arrayed as A3 in Spl.C.C. No. 79 of 2022 on the file of the Special Court for EC/NDPS Act Cases, Salem.

3. According to the prosecution, during a vehicle check on specific information, a car bearing registration No. TN 83 K 8313 was intercepted and from the car 200 kgs of ganja was seized. This petitioner fled from the scene of occurrence. Later, he was arrested and remanded to judicial custody on 15.06.2022. It is stated that the earlier bail petition was dismissed with a direction to the Trial Court to complete the trial within three months, but the same has not been completed. Hence, considering the long incarceration and delayed trial, bail may be considered.

4. Learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the trial in Spl.C.C. No. 79 of 2022 has commenced. Today, i.e., 03.09.2025, the case is posted for cross-examination of PW1.

5. Considering the said facts, the petition for bail stands dismissed, with a direction to the respondent police to marshal the witnesses on a dayto-day basis and complete the trial as expeditiously as possible. 03.09.2025 cda To 1.The Special Judge for EC/NDPS Act Cases, Salem. 2.The Inspector of Police, NIBCID Police Station, Salem District.
