Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C. to direct the Hon'ble I Additional District and Sessions Court (PCR) at Thanjavur to consider the bail application of the petitioner on his surrender in connection with the case in Crime No.446 of 2020 on the file of the Inspector of Police, Harithivaramangalam Police Station, Tiruvarur District on the same day.

ORDER

This Criminal Original Petition has been laid by the petitioner seeking direction to the I Additional District and Sessions Court (PCR) at Thanjavur, to accept the surrender of the petitioner in Crime No.446 of 2020 on the file of the second respondent and consider the bail petition on the same day itself.

2. According to the petitioner, he was arrayed as accused in crime No.446 of 2020, for the alleged offences under Sections 294 (b), 323 and 506(i) of IPC and under Sections 3(1)(r), 3(1)(s) & 3(2)(va) of SC/ST (Prevention of Atrocities) Amendment Act, 2015 and Section 4 of Prohibition of Harassment of Women Act, 2002. According to the petitioner, he has not committed the offences put forth against him and on account of the false case alleged against him, the petitioner is necessitated to seek for necessary directions.

3. Considering the facts and circumstances of the case and in the interest of justice, I deem it fit to issue the following directions.

(i) The petitioner shall surrender before the I Additional District and Sessions Court (PCR) at Thanjavur, within 10 days from the date of receipt of copy of this order. (ii) On the petitioner surrendering before the I Additional District and Sessions Court (PCR) at Thanjavur and filing the bail application, the I Additional District and Sessions Court (PCR) at Thanjavur, is directed to consider and dispose of the bail application as expeditiously as possible, preferably on the date of surrender in accordance with law.

4. Accordingly, the Criminal Original Petition is disposed of.
