ORDER

This Criminal Original Petition has been filed to modify the conditions imposed in the order dated 08.06.2018 made in Crl.M.P.No.3590 of 2018 on the file of the Court of Sessions, Villupuram Sessions Division, Villupuram by allowing this Criminal Original Petition.

2. The petitioner was arrested and remanded to custody in Cr.No.340 of 2018 on 14.05.2018 on the allegation that he had collected money from 11 persons promising them to get job abroad, however, he got them tourist visa, instead of employment visa. The petitioner filed Crl.M.P.No.3590 of 2018 before the Sessions Court, Villupuram, for bail, in which, he was granted bail on 08.06.2018 on certain conditions, one of which is that, he should deposit a sum of Rs.85,000/- as cash security. Aggrieved by the said condition, the petitioner is before this Court for modification.

3. Learned counsel for the petitioner submitted that on account of penury, the petitioner has not been able to deposit the amount, though bail was granted as early as 08.06.2018.

4. Taking all these factors into consideration, this Court is of the view that interests of justice would be served, if the sum of Rs.85,000/- imposed by the trial Court is reduced to a sum of Rs.25,000/- and accordingly, it is reduced. The trial Court shall deposit the sum of Rs.25,000/- in a Fixed Deposit account in any Nationalised Bank, so that the same can be disbursed after the culmination of the prosecution depending upon the outcome of the case.

With the above modification, this petition is ordered. The other conditions imposed, vide order dated 08.06.2018 in Crl.M.P.No.3590 of 2018, shall remain the same.
