..Respondents Writ Petition filed under Article 226 of Constitution of India seeking for issuance of Writ of Mandamus to direct the respondents to regularize the levy of land tax and water cess over the ayacut agricultural lands of the members of the petitioner society from the revenue department by properly categorizing in the land register records based on G.O.Ms.No.767 /PWD/ dated 20/04/1982, G.O. Ms. No. 1893 /PWD dated 13/09/1984, G.O.Ms. No.544 and G.O.Ms. No.545 Revenue (Va.Ni.1 (1) ) department dated 20/10/2010 instead of levying penal land tax and penal water cess. For Petitioner:

ORDER

This Writ Petition has been filed seeking for a direction to the respondents to regularize the levy of land tax and water cess over the ayacut agricultural lands of the members of the petitioner society from the revenue department by properly categorizing in the land register records based on G.O.Ms.No.767 /PWD/ dated 20/04/1982, G.O. Ms. No. 1893 /PWD dated 13/09/1984, G.O.Ms. No.544 and G.O.Ms. No.545 Revenue (Va.Ni.1 (1) ) department dated 20/10/2010 instead of levying penal land tax and penal water cess.

2. Though this Writ Petition has been filed for the aforesaid relief, at this stage of hearing of this Writ Petition, the learned counsel appearing for the petitioner would submit that it would suffice if the representation of the petitioner dated 28.04.2023, is directed to be disposed of by the respondents, within a stipulated period.

3. The learned Government Advocate appearing for the respondents would submit that the petitioner's representation dated 28.04.2023 will be disposed of by the 2nd respondent within a period of twelve weeks.

4. Heard the learned counsel for the petitioner and the Government Advocate appearing for the respondents and also perused the materials available on record.

5. Considering the submissions made by the learned counsel appearing on either side, this Court directs the 2nd respondent to consider the petitioner's representation dated 28.04.2023, on its own merits and pass orders on the same in accordance with law within a period of twelve weeks from the date of receipt of copy of this order, after issuing notice to the petitioner and after hearing the petitioner as well as the persons concerned and communicate the decision taken to the petitioner.
