Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider petitioner representation dated 26.06.2024 requesting the Respondents to survey and demarcate the boundaries of the land situated at Chinna Pillayur Kaatuvalavu, Thesavilaku Village, Omalur Taluk, Salem District 636 001 bearing Patta No 2158, 1941, 311 containing survey No.433/2C2, 437/7B2, 437/7C1, 433/1C, 437/9B, 437/7C2.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This Writ Petition is filed to direct the respondents to consider representation of the petitioner dated 26.06.2024 requesting the Respondents to survey and demarcate the boundaries of the land situated at Chinna Pillayur Kaatuvalavu, Thesavilaku Village, Omalur Taluk, Salem District 636 001 bearing Patta No 2158, 1941, 311 containing survey No.433/2C2, 437/7B2, 437/7C1, 433/1C, 437/9B, 437/7C2.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that he is the owner of the subject property and he acquired the same through a settlement deed dated 31.03.2004 executed by his father. The grievance of the petitioner is that though he has given a representation for surveying his land and demrcate of boundaries, the same has not been considered by the respondents till date. Hence, the present Writ Petition. 2/4

Considering the limited relief sought for in this writ petition, the respondents are directed to consider the representation of the petitioner dated 26.06.2024 and pass appropriate orders on the same, after giving notice to the neighbouring land owners and any other interest persons, within a period of two months from the date of receipt of a copy of this order.
