O R D E R

This Criminal Original Petition has been filed to direct the respondents not to harass the petitioner under the guise of enquiry.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate [Crl. Side] appearing for the respondents.

3.Today, Mr.D.Tamilarasi, WHC 1648, All Women Police Station, Erode District is present before this Court. On instructions, the learned Govt.Advocate [Crl. Side] submitted that on the complaint given by Vinodhini,a petition enquiry was conducted in CSR.No.441 of 2018 by the 2nd respondent and the same was closed on 15.06.2018. However, Vinodhini has given a fresh complaint to the 1st respondent, in which, a petition enquiry is pending and the 1st respondent has issued summons to the petitioner to appear on 14.07.2018.

4.In view of the above, the petitioner is directed to appear before the 1st respondent and cooperate with the police for enquiry and at the time of conducting enquiry, the petitioner shall not be harassed. During the course of enquiry, if any cognizable offence is made out, the respondent police is free to register an FIR and this order shall not be a shield for the petitioner against arrest.
