The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 406, 420, 506(i) I.P.C in Crime No.4678 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that, the petitioner has approached the defacto complainant by stating that he runs a firm named Dhana Finance at Mannargudi and he has facilitated loans for huge corporations. The de-facto complainant herein holding a Company namely Orchid Chemicals and Pharmaceuticals Ltd and he was in need of Rs.2,500,000000000/- for business development and the petitioner demanded Rs.1,75,00,000/- as advance towards facilitating the loan amount to the de-facto complainant's Company. The de-facto complainant paid Rs.1,73,00,000/- to the petitioner in four installments. But the petitioner herein did not arranged the loan as promise and the defacto complainant asked the same to the petitioner he threatened him. Hence the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prayed for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the interim bail was already granted to the petitioner on 05.01.2018. He has not co-operate for the trial in C.C.No.4678 of 2023 and hence Non-Bailable Warrant was issued against the petitioner. Hence, he opposed for grant of anticipatory bail to the petitioner.

5.Heard the learned Counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case and also the submissions made by the learned counsel on either side, since the Non-Bailable-Warrant has already issued by the Competent Court to the petitioner, this Court is not inclined to grant anticipatory bail 2/4

to the petitioner. It is open to the petitioner to move before the concerned Court with appropriate application.
