PRAYER: This writ petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondents 2 and 3 to remove the encumbrance in respect of petitioner's property in S.F.No. 24 situated at Komarapalayam Agraharam Village, Komarapalayam, Namakkal District by considering petitioner's representation dated 08.06.2023. ORDER
About 1.69 1⁄4 acres of land was allotted to the petitioner and his family members under partition deed dated 13.12.1991. According to the petitioner, his father executed a power of attorney in favour of one Dhavamani and the said agent executed a sale deed in favour of one Sigamani. Thereafter, the petitioner's father and the petitioner approached the District Munsif Court, Thiruchengode in O.S.No.165 of 2022 and the said suit was decreed under judgment and decree dated 16.07.2002. Since the entry made in the encumbrance certificate in respect of the sale deed in favour of Sigamani had not been deleted, the present writ petition has been filed.
2. Learned Special Government Pleader appears on behalf of all the respondents. He submits that the petitioner has the option of registering the decree of the civil court.
3. Unlike other documents that are required to be registered within a prescribed time limit, such time limit does not apply with regard to a decree of the court. Since the petitioner submits that the property was declared to be his father's and his under the decree of the civil court, the grievance of the petitioner would stand effectively redressed if the decree were to be registered. By leaving it open to the petitioner to take appropriate steps to register the decree, this writ petition is disposed of. No costs. 29-01-2026 KAL
