Both counsels would submit that they have no objection to appoint Justice Ravichandra Babu (Retd) as an Arbitrator to arbitrate the disputes between the parties.

2. The learned counsel for the respondent would express an apprehension that as on date, the construction has not been put up in the premises and in the guise of the pendency of the proceedings, construction should not be put up by the respondent.

3. It is needless to state that as on the date of the issue of the impugned notice, there was no construction in the premises. It is open to the respondent to take all the defenses before the Arbitral Tribunal.

4. The interim order already granted shall continue till the disposal of the Arbitral Proceedings.
